1. Agreement to Terms

By accessing or using the Agent For You website (agentforyou.ca) and services (“Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Agent For You.

2. Description of Services

Agent For You provides:

• AI Assistant: An AI-powered conversational assistant that provides general information about buying and selling homes in Canada
• Lead Generation: A service connecting users with licensed real estate professionals (“Partner Agents”)
• User Dashboard: An account area to view and manage your information

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be legally capable of entering into a binding contract
• Not be prohibited from using the Services under applicable laws

4. Account Registration

To access certain features, you must create an account by providing accurate information, verifying your email, and creating secure login credentials.

You are responsible for: maintaining credential confidentiality, all activities under your account, and notifying us of unauthorized use.

5. AI Assistant Terms

Your Obligations When Using AI

You agree to:

• Use AI responses as a starting point for research, not definitive advice
• Consult qualified professionals before making real estate, legal, financial, or tax decisions
• Not rely solely on AI responses for time-sensitive or high-stakes decisions
• Report any apparent errors or inaccuracies to us

6. Partner Agent Connections

Referral Service

When you request to be connected with a real estate professional, we may share your information with Partner Agents. You understand that:

• Partner Agents are independent professionals, not our employees
• We do not control their actions, advice, or services
• Any relationship you form is between you and that agent
• We receive referral fees from Partner Agents for introductions

No Endorsement

While we vet Partner Agents, our referral does not constitute an endorsement, guarantee of service quality, representation about outcomes, or warranty of any kind.

Your Responsibility

You are responsible for conducting due diligence, verifying licensing, negotiating terms directly, and making your own decisions about representation.

7. User Conduct

You Agree NOT To

• Violate any applicable laws or regulations
• Provide false or misleading information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Services
• Use automated means to access our Services without permission
• Attempt to reverse engineer our AI
• Use our Services to harm or harass others

Prohibited AI Uses

• Attempt to manipulate the AI to provide harmful or illegal advice
• Use the AI to generate spam or misleading content
• Attempt to extract training data or proprietary information
• Use AI responses for commercial purposes without permission
• Misrepresent AI responses as professional advice

8. Intellectual Property

All content, features, and functionality of our Services are owned by Agent For You or our licensors and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.

9. Disclaimers

No Professional Relationship

Your use of our Services does not create any professional relationship, including agent-client, attorney-client, or fiduciary relationship.

You agree to indemnify, defend, and hold harmless Agent For You and its affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your decisions made based on information from our Services

12. Termination

Termination by You

You may terminate your account at any time by contacting us at support@agentforyou.ca or using the account deletion feature in your dashboard.

Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, your actions may cause legal liability, or we discontinue the Services.

Effect of Termination

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive will survive (including disclaimers, limitations of liability, and indemnification).

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

Informal Resolution First

Before initiating formal proceedings, you agree to contact us at support@agentforyou.ca to attempt informal resolution for at least 30 days.

Class Action Waiver

You agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
